CFTC adopts rule excluding casino-style gambling from swap definition

The agency says the measure codifies its longstanding position and becomes effective immediately upon publication in the Federal Register.

The Commodity Futures Trading Commission issued an interim final rule on October 9, 2026, to incorporate its existing treatment of casino-style gambling into its regulations. The agency said those products fall outside the definition of a swap, including bets on sportsbooks and casino games.

Chairman Michael S. Selig said casino-style gambling does not constitute derivatives. He said formally recording the exclusion clarifies the scope of the CFTC’s authority, in line with its approach to other products traditionally regulated by states.

Publication in the Federal Register will make the rule effective immediately. The deadline for receipt of written comments through Regulations.gov is 30 days after that publication.
