CFTC seeks input on framework for retail crypto transactions

The agency is considering crypto-specific compliance guidance and a registration subcategory for markets dedicated to the transactions.

The Commodity Futures Trading Commission opened a public consultation on October 5, 2026, on its plans for a regulatory framework covering certain retail commodity transactions involving crypto assets. The agency said the framework would address transactions governed by section 2(c)(2)(D) of the Commodity Exchange Act, which it calls CTXs.

The CFTC is seeking views on preventing abusive practices through a nationwide regime and providing market participants with crypto-specific information about compliance requirements. It also wants feedback on industry practices that its oversight experience since 2014 has identified as best practices for complying with requirements applicable to CTXs.

Another issue under consideration is creating a designated contract market registration subcategory called a crypto asset market, specifically for CTXs. Chairman Michael S. Selig said the agency aims to develop rules that prevent fraud rather than relying solely on enforcement after misconduct occurs.

The commission said responses would help shape possible future action, including rulemaking. Written comments must arrive within 60 days after the notice appears in the Federal Register, and submissions will be made public on Regulations.gov.
