Legal Battle Intensifies as Noel Clarke’s Libel Case Against Guardian Moves Forward

Actor Noel Clarke's legal battle with Guardian News and Media (GNM) has taken a new turn as his attempt to strike out the newspaper's defence in his libel claim was unsuccessful. The case centers on a series of articles published by The Guardian, which featured allegations from several women accusing Clarke of groping and sexually inappropriate behavior on set. These articles emerged in the wake of Mr Clarke's threats of legal action.

The Guardian's coverage drew criticism from Clarke, who accused the newspaper of evidence fabrication and destruction of crucial messages. In particular, he highlighted an incident where The Guardian's head of investigations allegedly instructed two journalists to delete messages on the encrypted messaging app Signal. Despite these accusations, the newspaper has maintained its stance, defending its publications based on the grounds of truth and public interest.

Arthur Lo, representing Mr Clarke, argued for the removal of The Guardian's defence, claiming that the newspaper had engaged in misconduct. However, The Guardian rejected these allegations, asserting that much of the data Clarke claimed was destroyed had actually been retained and disclosed. To support its case, The Guardian disclosed 3,000 documents related to the proceedings.

Gavin Millar KC, barrister for The Guardian, described Mr Clarke's accusations as "hopelessly weak." He emphasized that the allegations of fabrication and destruction were unfounded. The newspaper also denied any perversion of the course of justice, reinforcing its commitment to transparency throughout the legal process.

With the trial set to commence in March, the court will delve deeper into the claims and counterclaims presented by both parties. The six-week trial is expected to scrutinize the evidence and testimonies related to the defamation claim. As it stands, The Guardian's defence remains intact, and Noel Clarke's lawsuit against the media entity continues.
