Judge Rules Against Trump Administration’s Takeover of U.S. Institute of Peace

This week a federal judge ruled that the Trump administration’s take over of the U.S. Institute of Peace ( USIP ) was illegal. The judge found the closure of the institute unlawful. Judge Beryl Howell of the U.S. District Court had previously ruled that the removal of all ten board members including the most visible member, Moose, was illegal. She directed their reinstatement without further delay.

Yet, to USIP’s benefit, the Trump administration acted resolutely to wrest control of USIP’s headquarters. They accomplished this with the help of their Department of Government Efficiency (DOGE), headed by advisor Elon Musk and protected by law enforcement. This move took place only two months prior to Howell’s ruling. He pointed out that USIP, as an independent, non-partisan organization based in Washington, D.C., functions beyond the stovepipes of the Executive branch.

In her order overturning his successors, Judge Howell characterized the officials who replaced Moose as “illegitimately installed.” As she explained, where Congress restricts the President’s removal power, that restriction is “squarely constitutional.” Howell added, “USIP’s existence outside of the Executive branch is the end of the inquiry.”

Established to promote peace and stability for over 40 years, USIP supports both the Executive and Legislative branches as an independent think tank. It is actively involved in international peace research, education, training and information service. USIP’s board, management and staff have applauded the ruling, and are looking forward to getting back on track with many of their essential programs.

The court’s decision leaves no doubt that an independent institution dedicated to U.S.-led efforts at peace and reconciliation around the world is indispensable. USIP is preparing to return its leadership to Washington and get back to business. Its purpose should be to accomplish its mission of cultivating worldwide peace—even here, amid this chaotic, bilious political environment.
