Dellinger Withdraws Lawsuit Following Court Ruling on Dismissal

Hampton Dellinger, who was fired last month by former President Donald Trump, has decided to drop his lawsuit challenging the dismissal. The announcement came shortly after a federal appeals court in Washington, D.C., ruled that he could be removed from his position while the legal battle unfolded. Dellinger had been appointed to the role last year by President Joe Biden, serving a key position at the U.S. Office of Special Counsel (OSC), a federal ethics watchdog.

The OSC is tasked with safeguarding federal employees who expose issues of waste, fraud, and abuse within the U.S. government. Dellinger, as part of his duties, had opposed efforts by the Trump administration to dismiss probationary employees. However, he decided to abandon his legal fight due to the potential length of time it might take to reach a resolution.

"I'm stopping the fight because, yesterday, circuit court judges reviewing the trial court decision in my favor granted the government's request that I be removed from office while the case continues," said Hampton Dellinger.

The federal appeals court's decision effectively allowed for Dellinger's removal, impacting his ability to continue in his top federal ethics position while the legal proceedings were ongoing. His statement indicated that he believed the three-judge panel's ruling and acknowledged the challenges it presented for his continued tenure at OSC.

"This new ruling means that OSC will be run by someone totally beholden to the President for the months that would pass before I could get a final decision from the U.S. Supreme Court," Dellinger added.

The decision to drop the lawsuit highlights the complexities involved when federal ethics positions become entwined with political dynamics. The OSC remains a crucial body for protecting whistleblowers who report government wrongdoing, and Dellinger's departure underscores ongoing tensions between federal employees and administrative actions.
