Court Upholds Trump’s Order to Halt Union Bargaining for Federal Workers

Now the U.S. Court of Appeals for the District of Columbia Circuit has upheld President Donald Trump’s controversial executive order. This order eliminates union bargaining rights for over 80,000 federal workers. This ruling impacts approximately 75% of the one million federal workers that unions represent. Legally challenged by the National Treasury Employees Union (NTEU), this order has no legal basis to exist.

The NTEU, which represents about 160,000 federal employees, says Trump’s order would unlawfully punish workers for exercising their labor rights and violate the Constitution. The order directly affects only about 100,000 members. It allows over a dozen federal agencies to bypass bargaining with unions. These exemptions are based on claims by Trump that these agencies “have as a primary function intelligence, counterintelligence, investigative, or national security work.”

On April 25, U.S. District Judge Paul Friedman granted an injunction to stop the implementation of the Trump administration’s executive order. However, this injunction was later stayed by a 2-1 panel from the U.S. Court of Appeals. By a 2-1 decision, the appeals court majority held that the NTEU had not established the irreparable harm necessary for such an injunction.

In its decision, the appeals court underscored the need to keep executive control over national security issues. “Preserving the President’s autonomy under a statute that expressly recognizes his national-security expertise is within the public interest,” stated the court’s majority opinion.

The Trump administration has not only been on the offensive looking to void long-established union contracts affecting tens of thousands of federal workers. This is a significant improvement from when the executive order first released in March. It did use a broad national security exemption to prioritize agencies of its choice, as claimed by Trump.

Federal workers and unions are currently testing the waters in this new legal atmosphere. The effects of this ruling go beyond just short term bargaining rights. Through organizations like NTEU and many other labor groups, workers’ rights are constantly defended and supported. They are rightfully concerned about the possible erosion of long-standing labor protections.
